We were one of the fortunate people able to qualify for the homebuyers tax credity $8k refund. We filed for it via an amended return and sent the HUD paperwork substantiating we qualified and were entitled to this refund. We mailed our return over 8 weeks ago and per the IRS CSR, it still is not even showing in their system. They proceed to remind me that it could take 12-16 weeks.
My husband has been on medical disability due to a heart attack and complications, and we need that money NOW. Is their a way to get a refund anticipation loan (RAL) against it? Should I refile the paperwork??

There is no need to refile the return or do a RAL, since the return has been filed already. The IRS is correct and it could take up to 12-16 weeks.
After 8 weeks I would think the IRS would show the return in their system at least being in review or in process. Usually they will confirm it has been received with no update info available if they haven't gotten to it yet. I would call them back to confirm they at least received it before waiting 12 weeks only to be told they never got it, what a waste of time! I've had several clients that have mailed their returns and god only knows what happened to them. Ask the IRS after they receive a return how long does it take them to log it into the system and that you're trying to determine if it has been lost in the mail. I suggest you confirm they haven't received it in the allotted time before refiling to avoid the IRS extra work which is going to delay others refunds.
I know that I filed my tax return before April 15 and after faxing 2 sets of the same documents to the IRS in Memphis they told me at the beginning of August that they were processing the tax returns from May 2010. And not to call to check on it until the end of September. I know I am like everyone else struggling but why should we have to wait for our refund when they don't wait for their payments due to them?
